The complaint cites the three years that Kofkoff Feed contracted Agway to provide nutrition and quality control advice for Kofkoff Feed. This agreement continued through March 1989.
In this case, Agway claims it never used lecithin in its feed. But a BFS person contacted Stock claimed that lecithin was a good ingredient and was a complete fat substitute. Agway, however, conducted the tests to see if the new ingredient would meet the specifications set by the BFS. In the end, it was found to be acceptable in terms of the specification sheets.
It was based on specifications provided by BFS
While BFS claims that Agway chicken feed was based on specifications from BFS, this defense has no basis in law. As a result, the court rejected BFS’s request for summary judgment. As a result, the case proceeds to trial. The next phase of the litigation will involve determining whether the chicken feed complied with BFS’s specifications. If it does, the court will rule on whether the claim is plausible.
Kofkoff Feed, a Connecticut corporation that manufactures chicken feed, filed a three count amended complaint against BFS. In February 1988, Kofkoff Feed entered into an agreement with Agway, providing quality control advice, nutritional services, and a chicken feed mix. The agreement lasted until March 1989. But BFS does not deny that Agway provided the chicken feed mix.
